ACCEPTANCE OF THESE TERMS

By visiting our website, placing an order, submitting a custom request, uploading artwork, approving a design proof, or otherwise using our services, you agree to these Terms of Service & Sale and to any policies linked from our website, including our Shipping & Delivery Policy, Returns, Refunds & Cancellations Policy, Privacy Policy, Cookie & Tracking Notice, Custom Artwork & Intellectual Property Policy, Accessibility Statement, and Copyright & Trademark Complaints Policy.

If you do not agree with these terms, do not use the website or place an order.

ELIGIBILITY

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order. By placing an order, you confirm that you have the authority to use the payment method, shipping address, billing details, custom text, artwork, logo, image, or design materials submitted with the order.

PRODUCTS AND PRODUCT INFORMATION

We make or sell laser-engraved products, collector accessories, display items, personalized keepsakes, and related goods. Product descriptions, photos, dimensions, compatibility notes, materials, finishes, and estimated production times are provided to help you decide whether an item is right for you.

Because many products are engraved, made by hand, finished individually, photographed under different lighting, or made from materials that may vary naturally, the finished product may differ slightly from photos or previews. Minor differences in wood grain, acrylic tone, engraving darkness, layout, material texture, alignment within normal production tolerance, or screen-to-product color are not usually defects.

Unless a product page states otherwise, the sale includes the physical product described on the product page only. Accessories, trading cards, graded slabs, props, staging items, display cards, third-party branded items, or background objects shown in photos are not included unless specifically listed.

ORDERS, ACCEPTANCE, AND AVAILABILITY

Placing an order is an offer to purchase the listed product or custom service. An order is accepted only when we confirm payment and determine that the order can be produced, fulfilled, shipped, and legally completed.

We may decline, cancel, or modify an order before shipment if:

• The item is out of stock or unavailable.
• The product listing, price, shipping rate, tax, or description contains an error.
• The custom request cannot be produced safely, legally, or at the quality level expected for the product.
• The submitted artwork, logo, name, image, character, brand reference, design, or text appears unauthorized, infringing, unlawful, abusive, misleading, or prohibited by our policies.
• Payment is declined, disputed, suspected to be fraudulent, or cannot be verified.
• The shipping address is incomplete, invalid, or outside the areas we serve.
• We reasonably believe the order violates these terms, payment processor rules, or applicable law.

If we cancel an order that has already been paid, we will refund the affected portion of the order unless the cancellation is caused by fraud, chargeback abuse, completed custom design work, or another reason for which a refund is not required by law or by our policies.

PRICES, CURRENCY, TAXES, AND PROMOTIONS

All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, product availability, shipping rates, and taxes may change without notice before an order is placed.

Taxes may be calculated and collected at checkout where required. If tax is not collected at checkout, you may still be responsible for applicable use tax or other obligations in your jurisdiction.

Promotional pricing, coupons, sale prices, discounts, and limited-time offers may be changed, limited, or ended at any time unless a specific promotion states otherwise. Promotions are not applied retroactively to previous purchases and may not be combined unless expressly stated.

PAYMENT

Payments are processed by Stripe or another payment provider we may use in the future. Card details are encrypted and handled by the payment provider. Ironwall Engraving does not store full card numbers.

We may store order totals, transaction IDs, payment status, refund status, chargeback or dispute information, and related order records so we can fulfill orders, provide support, handle refunds, comply with tax and accounting obligations, and resolve payment questions.

Charges may appear on your statement as IRONWALL ENGRAVING or a similar payment descriptor.

CUSTOM ORDERS, PERSONALIZATION, AND DESIGN PROOFS

Many Ironwall Engraving products are custom, personalized, made-to-order, engraved, or produced based on customer-submitted instructions. Custom work may include names, dates, initials, logos, short messages, artwork, images, layout instructions, or product-specific design requests.

You are responsible for submitting accurate information. This includes spelling, capitalization, dates, names, numbers, addresses, file uploads, logos, layout instructions, product selection, size, color, quantity, and shipping details.

If a design proof is provided, production may not begin until you approve the proof. By approving a proof, you confirm that the spelling, layout, size, artwork, text, product, and design choices are correct. After proof approval, customer-requested changes may require extra charges or may not be possible.

If you do not respond to a proof request, clarification request, or design question within [INSERT NUMBER] business days, we may delay production, cancel the order, refund the order, or complete the product using the information already provided, depending on the situation.

If no proof is offered for a product, we may produce the order based on the information submitted at checkout or through our custom request process.

WHEN CUSTOM PRODUCTION BEGINS

For purposes of cancellation and refund decisions, custom production may begin when any of the following occurs:

• We begin design setup, file preparation, artwork cleanup, proof creation, layout work, or engraving setup.
• Materials are selected, cut, staged, engraved, masked, finished, packaged, or otherwise allocated to your order.
• A custom file, jig, template, test engraving, or production process is prepared for your order.
• We begin any other labor specific to your custom product.

Once custom production begins, cancellation and refund options may be limited as described in our Returns, Refunds & Cancellations Policy.

CUSTOMER-SUBMITTED CONTENT

Customer-submitted content includes names, text, artwork, logos, photos, files, images, character references, design notes, custom instructions, and any other material you provide to us.

By submitting customer content, you represent and warrant that:

• You own the content or have permission from the owner to use it for the requested product.
• The content does not infringe or violate copyrights, trademarks, trade dress, publicity rights, privacy rights, design rights, licensing agreements, or other rights.
• The content is not counterfeit, unlawful, fraudulent, threatening, abusive, hateful, discriminatory, sexually exploitative, or otherwise prohibited by our policies.
• The content does not include private, confidential, sensitive, or regulated information that should not be used in a custom engraved product.

You grant Ironwall Engraving a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, resize, adapt, engrave, print, display internally, store, and process your submitted content only as reasonably necessary to review, design, produce, fulfill, document, support, ship, and resolve issues related to your order, comply with law, enforce our policies, or protect our rights.

Unless you give separate permission, we will not intentionally use personal names, private messages, customer-submitted photos, or uniquely identifying custom artwork in public marketing in a way that reveals private customer information.

INTELLECTUAL PROPERTY AND THIRD-PARTY BRANDS

Ironwall Engraving is an independent custom engraving business. Unless expressly stated in writing, our products are not licensed, sponsored, endorsed, manufactured, approved, or affiliated with any trading card company, game publisher, entertainment brand, sports league, grading company, card manufacturer, artist, retailer, trademark owner, copyright owner, or other third party.

Third-party names, marks, or references may be used only for truthful compatibility, identification, descriptive purposes, or customer-requested personalization where permitted. You may not submit unauthorized logos, copyrighted images, character art, team marks, brand names, celebrity likenesses, or other protected materials unless you have the legal right to use them for the requested product.

Purchasing a physical product from us does not transfer ownership of our website content, product photos, shop-created design files, templates, production files, mockups, tooling, engraving settings, business name, logos, branding, or other intellectual property. Unless we agree in writing, you are buying the physical item only, not digital source files, commercial design rights, templates, or reproduction rights.

PROHIBITED ORDERS AND CONTENT

We may refuse, cancel, or request changes to orders involving:

• Unauthorized copyrighted artwork, logos, characters, brand names, team marks, celebrity likenesses, or other protected content.
• Counterfeit, misleading, knockoff, or falsely branded goods.
• Content that appears to impersonate a brand, certification, grading company, government agency, school, employer, or official document without permission.
• Hate speech, harassment, threats, doxxing, violent encouragement, or discriminatory content.
• Sexually exploitative content, content involving minors in a sexual context, or non-consensual intimate content.
• Illegal products, fake IDs, fraudulent documents, regulated weapons modifications, or requests that appear designed to break the law.
• Designs that create safety risks, structural problems, fire hazards, sharp hazards, choking hazards, or product quality problems.
• Any other content we reasonably believe violates law, payment processor rules, marketplace rules, or our policies.

We are not required to explain every refusal decision in detail, especially when doing so could create legal, security, privacy, or fraud risk.

SHIPPING AND DELIVERY

Shipping, production timing, tracking, damaged packages, missing packages, address errors, carrier delays, and domestic service areas are governed by our Shipping & Delivery Policy.

Production time is the time needed to make or prepare your order before carrier handoff. Delivery time is controlled by the carrier after handoff. If we cannot ship within the stated or reasonably expected production window, we will contact you with an updated estimate and cancellation or refund options when required by law.

RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, cancellations, replacements, remakes, and damage claims are governed by our Returns, Refunds & Cancellations Policy.

Personalized, engraved, made-to-order, customer-approved, or custom products are generally not returnable for buyer's remorse, customer-submitted errors, spelling mistakes submitted by the customer, wrong product selection, wrong address, approved design choices, or change of mind after custom production begins.

If we make a production error or the item arrives damaged, contact us promptly with your order number and photos so we can review a remake, replacement, partial refund, or refund.

PRODUCT SAFETY; NOT A TOY

Unless expressly stated on a product page, our products are collector accessories, display items, storage accessories, personalized keepsakes, or gift items. They are not toys and are not intended for children under 13.

Some products may include small parts, packaging materials, magnets, acrylic, wood, hardware, sharp edges, cords, adhesives, finishes, or other components that may present hazards if misused. Keep products and packaging away from young children and pets. Use products only as intended.

WEBSITE USE AND SECURITY

You agree not to misuse the website, interfere with checkout, probe or attack security, attempt unauthorized access to private owner tools, scrape content in an unreasonable manner, submit malicious code, bypass access controls, manipulate pricing, abuse promotions, or use the website for fraud.

Public links to owner tools or administrative areas, if any, are for authorized owner or staff access only. They do not grant permission for public use, testing, scanning, or attempted access.

THIRD-PARTY SERVICES

Our website and business operations may use third-party services such as payment processors, shipping platforms, carriers, authentication providers, hosting providers, email providers, analytics providers, tax tools, accounting tools, and security services. These providers may have their own terms and privacy practices.

We are not responsible for third-party service outages, carrier delays, payment network issues, or external websites that we do not control, but we will make reasonable efforts to support customers when a third-party issue affects an order.

LIMITED WARRANTY AND DISCLAIMERS

We stand behind our workmanship and want customers to receive the product they ordered. If you believe an item has a production defect, arrives damaged, or does not match the approved order, contact us promptly.

To the fullest extent permitted by law, products and services are provided without warranties beyond those expressly stated on the website, in an order confirmation, or required by law. We do not guarantee that the website will be uninterrupted, error-free, secure, or available at all times.

Nothing in these terms limits rights that cannot legally be limited.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Ironwall Engraving will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, lost business, reputational harm, missed gifting deadlines, carrier delays, third-party service outages, or unauthorized use of customer-submitted content by third parties.

To the fullest extent permitted by law, our total liability for any claim related to an order will not exceed the amount you paid for the affected product or service.

This limitation does not apply where prohibited by law.

INDEMNIFICATION FOR CUSTOMER CONTENT AND MISUSE

You agree to defend, indemnify, and hold harmless Ironwall Engraving from claims, damages, losses, costs, and expenses, including reasonable attorney fees, arising from:

• Customer-submitted content that infringes or violates third-party rights.
• Your misuse of the website or products.
• Your violation of these terms or our policies.
• Your fraudulent, unlawful, or unauthorized activity.
• Your instruction that we produce a product using content you were not authorized to use.

DISPUTES AND GOVERNING LAW

These terms are intended to be governed by the laws of the State of Missouri, without regard to conflict-of-law rules, unless another law applies and cannot be waived.
